Laws & Regulations | How to Work Legally in China?

As per Article 32 of Constitution of the People's Republic of China: The People’s Republic of China protects the lawful rights and interests of foreigners within Chinese territory; foreigners on Chinese territory must abide by the laws of the People’s Republic of China. While study in China, international students should abide by relevant laws and regulations. We share a series of Chinese laws related to international students for your knowledge.


How do Foreigners Work Legally in China?


Note:  Not applicable for those who are currently on study visa. If you are interested and qualified to get a work permit, please process leaving procedures from university first. Please note that if you changed to working visa, your study status will be automatically terminated. Working illegally without work permit/work visa is punishable according to Chinese laws.




According to the Exit and Entry Administration Law of the People’s Republic of China,

any of the following acts of foreigners shall be deemed unlawful employment:

(1) Work in China without obtaining work permits or work-type residence permits in accordance with relevant regulations;

(2) Work in China beyond the scope prescribed in the work permits;

(3) Foreign students work in violation of the regulations on the administration of foreign students working to support their study in China and work beyond the prescribed scope of jobs or prescribed time limit.


Foreigners who work in China illegally shall be fined not less than RMB 5,000 but not more than RMB 20,000 yuan; where circumstances are serious, they shall be detained for not less than five days but not more than fifteen days and shall also be fined not less than RMB 5,000 yuan but not more than RMB 20,000 yuan. Foreigners who work in China illegally may be repatriated.


If you work illegally, you will not be able to get the proof of no crime.

If you work illegally, you will also lose the chance to study, get employment or even enter China in the future.
